DEFINITION AND SUBJECT OF THE CONTRACT
This contract is governed by Legislative Decree no. 206/2005 (Consumer Code) and subsequent amendments. The contract concerns the sale of cosmetic and perfumery products between the company AVAU Srl, headquartered in Rome at Via Pindaro 82, tax code and VAT no. 07110331001, and the consumer (the customer). The contract is finalized directly through the acceptance by AVAU of a purchase proposal submitted by the customer via the website www.avauparfum.com for products marketed by AVAU.

PRICES
The sale prices of the products displayed on the website include VAT and any other applicable taxes. Delivery costs are indicated separately in a dedicated section and vary depending on the nature of the shipment.

PURCHASING AND PAYMENT METHODS
Purchases are made through the e-commerce website's online system. Accepted payment methods include only the following: secure payment via a dedicated technological platform using a credit card on the e-commerce website, and any other payment method indicated as valid by AVAU on its website www.avauparfum.com.

PRODUCT DELIVERY – COMPLAINTS
Products are delivered to the address provided by the customer within 15 days of the conclusion of the contract via express courier. Avauparfum.com ships throughout Italy using express courier services; a shipping fee of €6 will be applied for orders under €50, and a €6 handling fee will be charged for cash-on-delivery payments.

PRODUCT AVAILABILITY
AVAU accepts customer orders within the limits of the product quantities available in stock. Therefore, AVAU’s acceptance of the customer’s purchase proposal is subject to the availability of the products in its warehouse. AVAU undertakes to promptly notify the customer of any stock shortages due to high demand or other reasons.

WARRANTIES AND CUSTOMER SUPPORT
The rules on warranties and customer support for the sale of consumer goods apply to products purchased by the customer.

CUSTOMER OBLIGATIONS
The customer declares and guarantees: to be a consumer as defined in Article 3 of the Consumer Code; to be of legal age; that the data provided for the execution of the contract is correct and truthful.

RIGHT OF WITHDRAWAL
The right of withdrawal is reserved for private consumers and is not available to customers purchasing with a VAT number. If the purchase was made by a private customer (i.e., without requesting an invoice), they may withdraw from the purchase contract for any reason within 15 days from the delivery date.
To exercise the right of withdrawal, the following rules must be observed:

  • The deadline for returning the goods is a maximum of fourteen working days from the date of receipt. For deadline purposes, the goods are considered returned when handed over to the accepting post office or courier.
  • The integrity of the product to be returned is an essential condition for exercising the right of withdrawal. As these are cosmetic products, they must be returned unopened in their original packaging. Returns of products without their original packaging or that are opened, used, or otherwise damaged will not be accepted.

Customers are advised to check the package's condition upon delivery by the courier and not to accept packages showing signs of tampering. AVAU will not accept returns based on photos sent after the package has been received.

The only expenses borne by the consumer for exercising the right of withdrawal are the direct costs of returning the goods to the sender. AVAU will not accept returns of products sent with freight collect shipping.
Within fourteen days from the date on which the right of withdrawal is exercised, the sums paid will be refunded to the consumer.
To return products under the right of withdrawal, the customer must first inform AVAU in writing by sending an email to info@avauparfum.com or a registered letter containing the purchase details: customer name and address, purchased products, order number, price paid, and purchase date. The customer will then receive a confirmation email from AVAU authorizing the return.

The package must include all free samples received and be shipped via a trackable service.

COMPETENT COURT
The contract is governed by Italian law. Any dispute relating to the application, execution, interpretation, or breach of the contract will fall under the jurisdiction of the Court of Rome.
